1. Acceptance of Terms

By accessing and using SophIA 2.0 ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

SophIA 2.0 is an AI-powered content generation platform that provides:

• AI chat interface for Q&A and assistance
• Loop Generator for iterative content refinement
• File upload and context integration
• PDF generation and export

The Service uses AI models (currently Ollama/Llama3, migrating to Google Gemini) to generate responses.

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One person or entity may not maintain multiple free accounts

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Generate illegal, harmful, or abusive content
• Harass, threaten, or impersonate others
• Violate intellectual property rights
• Spread misinformation or malware
• Attempt to bypass rate limits or security measures
• Scrape or automate requests without permission
• Resell or redistribute the Service

5. Intellectual Property

5.1 Your Content

You retain all rights to prompts, files, and input you provide ("Your Content"). By using the Service, you grant us a license to process Your Content to provide the Service.

5.2 Generated Content

You own the AI-generated output. However:

• AI output may not be unique (other users may receive similar results)
• We may use anonymized output to improve our models
• You are responsible for reviewing and fact-checking generated content

5.3 Our Platform

SophIA 2.0, including all code, design, and branding, is protected by copyright and other intellectual property laws.

6. Payment Terms

6.1 Pricing

Current pricing tiers:

• Free: $0/month - 100 credits
• Starter: $9/month - 1,000 credits
• Pro: $29/month - 5,000 credits
• Business: $99/month - 25,000 credits

6.2 Billing

• Subscriptions are billed monthly in advance
• Credits reset at the start of each billing cycle
• Unused credits do not roll over
• All payments are processed through Stripe

6.3 Refund Policy

Refunds are provided within 7 days of purchase if less than 10% of credits have been used. Contact support@sophia.ai for refund requests.

6.4 Price Changes

We reserve the right to modify pricing with 30 days notice. Existing subscribers will be grandfathered for their current billing period.

7. Credit System

Credits are consumed based on AI model usage (token count):

• Approximately 1 credit = 1,000 tokens
• Chat messages: ~0.5-2 credits per message
• Loop projects: ~10-50 credits depending on complexity

8. Service Availability

While we strive for 99.9% uptime:

• The Service is provided "as is" without guarantees
• We may perform maintenance with notice
• Emergency maintenance may occur without notice
• We are not liable for downtime or data loss

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We do not guarantee accuracy of AI-generated content
• You use the Service at your own risk

10. AI Disclaimer

AI-generated content may:

• Contain factual inaccuracies
• Be biased or inappropriate
• Violate third-party rights
• Require human review and editing

You are responsible for reviewing, fact-checking, and ensuring compliance of all generated content.

11. Termination

Either party may terminate the agreement:

• You may cancel your subscription anytime from account settings
• We may terminate for violations of these terms
• Upon termination, your data will be deleted per our retention policy

12. Changes to Terms

We may modify these terms with 30 days notice. Continued use after changes constitutes acceptance. Material changes will be communicated via email.

13. Governing Law
